A long time ago in 1816, following the Chartering of the 2nd Bank of the United States, the state of Maryland imposed a tax on the Bank. A Baltimore bank cashier, James McCulloch, refused to pay the tax, and because of the strife, the issue was brought to court.

Once in court, the appeals court that McCulloch's case was sent to in Maryland held that the Bank of the United States was unconstitutional. They believed that nowhere in the Constitution did it explicitly grant permission for a Bank to be created.

The final ruling on the Bank of the US was not decided in the Appellate Courts of Maryland, though..... The case was brought before Chief Justice, John Marshall, and the Supreme Court, the top level of law interpretation in the United States. Before McColluch v Maryland, the constitutionality of the Bank was never determined by the Supreme Court. Nevertheless, it was constantly debated by Founding Fathers and historical figures such as Alexander Hamilton (its creator), Thomas Jefferson (its greatest opposer), and was allowed by First President, George Washington.

John Marshall and the Supreme Court

Once the case was brought to the Supreme Court, the justices, led by Chief Justice John Marshall, had to decide if something that is not explicity stated in the Constitution, but would be good for the United States of America can be carried out. The decision of this case was so important because it would not only decide if a bank is Constitutional, but can affect future rulings on Constitutionality of bills or ideas not explicity stated in the Constitution!

Somewhere in the Constitution, there must be an answer, and if not, the answer would be no.
